Before using the fitness equipment provided in your room and/or following any exercises made available by the hotel please read the below.

By using the equipment and/or following the exercises provided, you confirm that you have read and accepted these Terms of Use.

Safety Guidance

Before using the equipment and following the exercises, please ensure that:

you exercise within your own limits and physical ability;
the surrounding space is clear and suitable for safe use;
the equipment is used only as intended and in accordance with any instructions provided;
the equipment is inspected by you prior to use and not used if you believe it may be damaged or unsafe; and
the equipment is kept safely away from children when not in use.

If you have any medical condition, injury, concern about your health, or have not exercised recently, you should consult a qualified healthcare professional before using the equipment.

Your Confirmation

By using the equipment or participating in any exercises provided, you confirm that:

you are aged 18 or over;
you believe yourself to be medically fit and able to undertake exercise safely;
you are not under the influence of alcohol, medication, or any substance that may affect your ability to exercise safely;
you will follow all safety guidance and instructions provided;
you will stop exercising immediately if you feel pain, discomfort, dizziness, or unwell.
you will only use the equipment only for its intended purpose;
you will report any defect, damage, or concern regarding the equipment to hotel staff as soon as possible; and
you will report any accident or injury occurring during use as soon as reasonably practicable.

Assumption of Risk

Exercise involves inherent risks. By choosing to use the equipment or following the exercises, you acknowledge and accept that you are participating voluntarily and at your own risk.

Limitation of Liability

To the fullest extent permitted by law, Paragon Studio and the hotel, and their affiliates, directors, officers, employees, contractors, agents, insurers and suppliers shall not be responsible for any loss or damage arising from your use of the equipment or participation in exercise activities.

To the fullest extent permitted by law, you waive, release, covenant not to claim, and discharge (and procure that your heirs, assigns, spouses, partners, next of kin or personal representatives waive, release, covenant not to claim, and discharge) Paragon Studio and the hotel and any of their affiliates, directors, officers, employees, contractors, agents, insurers or suppliers from any and all liability, now or in the future, for any claims, conditions, injury, disability, death or loss or damage to person or property arising out of your use of the equipment or participation in the exercises provided.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, or any other liability which cannot be excluded under applicable law.
